These Terms of Service ("Terms") are an agreement between you and Forever Fireflies ("we," "us," "our"). They cover your use of the Forever Fireflies mobile app and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
To use Forever Fireflies, you must be at least 18 years old (or the age of majority where you live) and able to enter a binding agreement. The app is made for parents and guardians — it is not intended for use by children.
When you add a child's name, birthday, or other details, you confirm that you are that child's parent or legal guardian, or that you otherwise have the right to record and store the information and recordings you create about them.
You're responsible for the account you create. Keep your sign-in details safe, give accurate information when you sign up, and keep it current. Let us know promptly if you believe someone else is using your account. You're responsible for activity that happens under your account.
Everything you create in the app — your voice recordings, transcripts, written entries, photos, and the child profiles you set up — is yours. We call this "Your Content," and you keep all ownership of it.
To run the app for you, you give us a limited license to store, back up, process, and display Your Content, only to provide and improve the Service for you. For example, we store your audio so you can play it back, and we send entry text (never your audio files) to our AI provider to suggest titles and tags. We don't claim ownership of Your Content, we don't sell it, and we don't use it for advertising. Our Privacy Policy has the full detail on how your data is handled.
You're responsible for what you record. By saving content, you confirm you have the right to record and store it, including the words and voices of other people captured in your recordings.
Forever Fireflies uses AI to help with your entries — suggesting a title, cleaning up a transcript, and proposing tags. This processing uses the text of your entry only; your audio files are never sent to any AI service. AI suggestions are automated and won't always be perfect, and you can edit or replace any of them. There's more detail in our Privacy Policy.
Forever Fireflies offers a free trial. When the trial ends, recording new memories and playing back audio require a paid subscription. Memories you've already saved remain available to view either way.
Subscriptions are sold as auto-renewing plans (for example, monthly or annual). The current prices and trial length are shown in the app before you buy. Payment is charged to your Apple App Store or Google Play account when you confirm the purchase.
Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it any time in your App Store or Google Play account settings — deleting the app does not cancel a subscription. Refunds are handled by the app store you bought through, under their policies. We may change prices; if we do, the new price applies to future billing periods, and we'll give notice where required.

The Service itself — the app, its software, design, and the "Forever Fireflies" name and logo — belongs to us and is protected by intellectual-property laws. We give you a limited, personal, non-transferable license to use the app for your own non-commercial use. These Terms don't give you any rights to our trademarks or branding.
Forever Fireflies relies on services from other companies — including Apple, Google, and our infrastructure and analytics providers — to work. Your use of the app may also be subject to their terms, such as the App Store or Google Play terms. We're not responsible for third-party services we don't control. The companies we use are listed in our Privacy Policy.
We work hard to keep your memories safe, but the Service is provided "as is" and "as available," without warranties of any kind. We don't promise the Service will always be available, error-free, or uninterrupted, and we can't guarantee that content will never be lost. Please keep your own copy of anything truly irreplaceable. Forever Fireflies is a journaling tool — it is not a substitute for professional, medical, or legal advice.
To the fullest extent allowed by law, Forever Fireflies will not be liable for any indirect, incidental, special, or consequential damages, or for lost data or lost memories, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US $50, whichever is greater. Some places don't allow these limits, so parts of this section may not apply to you.
You agree to cover and hold us harmless from claims, losses, or costs (including reasonable legal fees) that arise from your misuse of the Service, your violation of these Terms, or your violation of someone else's rights.
You can stop using Forever Fireflies at any time and delete your account from the app's settings or our account deletion page. We may suspend or end your access if you break these Terms or if we're required to by law. When your account ends, your license to use the app ends, and your data is deleted as described in our Privacy Policy.
We may update these Terms from time to time. If we make a significant change, we'll let you know through the app or by email. The "last updated" date at the top of this page always shows the current version. By continuing to use the Service after a change takes effect, you accept the updated Terms.
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Any disputes relating to these Terms or the Service will be handled in the state or federal courts located in Illinois, and you agree to that jurisdiction — except where the law where you live gives you the right to resolve disputes elsewhere.
